01 About these terms
These terms apply when you use the Choose Speed website and when you buy a digital product from us. The website is run by Choosespeed Ltd, company number 14291295, registered in England and Wales, registered office 21 Percy Road, Warwick, CV34 5EU. Email: contact@choosespeed.com.
By using the website you agree to these terms. If you do not agree, please do not use it. Services we agree with you in writing are covered by that written agreement as well. If the two conflict, the written agreement comes first.
02 Using the website
You may use the website for lawful purposes only. You must not:
- try to break into, overload or disturb the website, or test its security without our written permission
- copy the website automatically in a way that harms it or goes beyond normal use
- use it to send us unlawful, harmful or misleading content
- pretend to be someone else when you contact us
We may limit or stop access to anyone who breaks these rules.
03 Our services
What we describe on this website explains what we do. It is not an offer that binds us. A service starts only when we have agreed the scope, the price and the timing with you in writing, usually in a quote or a contract.
We work with care and skill, but we do not promise a particular result, such as a search ranking, a number of visitors, sales or the absence of every possible fault.
Security testing is different from other work. We test only systems that you own or are authorised to test, and only after you have confirmed this and we have both agreed the scope in writing. We do not test anything without that written agreement.
04 Buying from the store
When you place an order, you make an offer to buy. A contract begins when your payment is confirmed and we send you access to your download. We may refuse or cancel an order if there is a mistake in the price or the description, or if we suspect fraud. If we do, we return any money you paid.
The price you pay is the total shown at checkout before you confirm. Payment is taken by our payment provider on its own page, and we never see your full card number.
05 Digital products and licences
Templates, phone themes and other digital products are licensed to you, not sold. When you buy one, you may use it for your own project or, if it says so on its page, for your clients' projects, under the licence shown on the product page.
Unless a product page says something different, you may not:
- resell, share, publish or redistribute the files, alone or as part of another product
- claim the work as your own creation or remove our credits where the licence asks you to keep them
- use the files in a way that is unlawful or that breaks someone else's rights
A licence covers only what its page states, for example the number of projects, devices or people. If you need more, ask us for a different licence. We may end a licence if you break its terms.
06 Ownership of the website and its content
The website, its design, text, drawings, logos and code belong to Choosespeed Ltd or are used with permission. You may view and share links to the pages. You may not copy or reuse them beyond that without our written consent.
Work shown in our showcase belongs to its owners. We show it with their permission. Names, logos and screenshots of other companies belong to them.
07 Links to other websites
The website links to other websites. We do not control them and are not responsible for what they contain or how they treat your data.
08 Availability and changes
We try to keep the website available, but we do not promise that it will always work without interruption or error. We may change, suspend or remove parts of it, and we may update products, prices and these terms. A change to the terms applies from the date we publish it and does not change a purchase you have already made.
09 Our responsibility to you
Nothing in these terms limits or excludes:
- our liability for death or personal injury caused by our negligence
- our liability for fraud or fraudulent misrepresentation
- your legal rights as a consumer, including the right to digital content that is as described, of satisfactory quality and fit for its purpose
- any liability that the law does not allow us to limit
Subject to that, and for business customers, we are not liable for loss of profit, revenue, data or goodwill, or for indirect loss, that arises from using the website or a product. Our total liability to a business customer for one claim is limited to the amount that customer paid for the product or service that the claim concerns.
10 Your privacy
How we use personal data is explained in our privacy notice, and how we use cookies is explained in our cookie policy.
11 Refunds and delivery
How downloads reach you, how you can cancel and when we return money is explained in our refunds and delivery policy. It is part of these terms.
12 Changes to these terms
We may change these terms. The version on this page, with its date, is the one that applies.
13 Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales may decide a dispute. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring a claim in the courts of that country. If you are a consumer in Scotland or Northern Ireland, you may also bring a claim in your local courts.
